UPDATE: SCOTUS Denies Year-round E-15 Appeal

A leading ethanol industry group, Growth Energy, says it will keep working to gain approval for year-round use of E-15, following the Supreme Court’s announcement this week that it had denied a petition from the biofuels group. The petition would have allowed E-15 rules to remain in place and support full times sales of the product. Legislation has already been introduced in the Senate to allow year-round use and correct this situation.

EDITOR’S TAKE:

Disappointing, but not totally unexpected. We reported in last week’s AIR that the Supreme Court would be making its decision and was unlikely to hear the case that was an appeal from a lower court. A legislative fix is not out of the question, but only time will determine how rapidly such a remedy can be put into place. Let’s hope the legislative process moves a little faster than normal in this instance!
